This Privacy Policy provides information about how we collect, use, store and process your personal data, so please read this Privacy Policy carefully before you start using the services of SIA “LINGENT”. When registering or otherwise using the SIA “LINGENT” website, you will be required to confirm that you have read and understood this Privacy Policy.
Definitions used:

Third party – a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who are authorised to process personal data under the direct authority of the controller or processor.
Consent of the data subject (client) – a freely given, specific, informed and unambiguous indication by the Client, in the form of a statement or a clear affirmative action, that the Client agrees to the processing of their personal data.
Cookies – text files that are stored on the user's device to individualize the usability of the SIA "LINGENT" website for each specific website user.
General rules
1.1. SIA “LINGENT” is committed to protecting and respecting your privacy. We do everything possible to ensure that our processing of personal data complies with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

1.3. The processors of your personal data are legal entities that process personal data on behalf of SIA “LINGENT” and in accordance with the instructions of SIA “LINGENT”, and who are committed to complying with the requirements of regulatory enactments in the field of data processing.
1.4.1. When processing personal data, the Controller:
1.4.1. ensures the legality and integrity of the processing of personal data;
1.4.2. respects the rights of the Client;
1.4.3. The Customer is provided with transparent information about the fact that their personal data is being collected, used, accessed or otherwise processed, and the extent to which the personal data is or will be processed, indicating the specific purposes of the processing;
1.4.4. ensures that personal data are adequate, relevant and necessary for the purposes for which they are processed. The Controller processes only such data and to the extent that it is consistent with the Controller's business activities to ensure the provision of services/sale of goods.
1.4.5. ensures that Personal data is not stored for longer than necessary, that is - as long as the contract concluded with the Client is valid, as long as the Controller or the Client can realize their legitimate interests in accordance with the procedures specified in external regulatory enactments, as long as one of the parties has a legal obligation to store the data, as long as the Client's consent to the relevant processing of personal data is valid, if there is no other legal basis for data processing. After the personal data storage period has expired, personal data are permanently deleted.
1.4.6. ensures that Personal Data is accurate, ensures that inaccurate Personal Data is corrected or deleted.
1.4.7. ensures that Personal Data is processed in a manner that ensures appropriate security and confidentiality of Personal Data, including preventing unauthorized access to or use of Personal Data and unauthorized access to systems and equipment used for data processing.
1.4.8. ensures that Personal Data is not transferred without secure and adequate protection.
Legal basis for processing personal data
2.1. Your personal data is processed on the following legal grounds:

2.2. By choosing not to provide personal data in any part or by withdrawing consent in whole or in part (with respect to specific data provided), SIA “LINGENT” will not be able to provide the client with the services for which the relevant personal data is required.
Personal data and purposes of their processing
3.1. The controller processes personal data for the following purposes:
3.1.1. For Customer identification;
3.1.2. for the preparation and conclusion of the contract;
3.1.3. for the delivery of goods and provision of services (for the fulfillment of contractual obligations);
3.1.4. for advertising and distribution of goods or for commercial purposes;
3.1.5. For customer service;
3.1.6. Creation and management of the Customer profile;
3.1.7. for the consideration and processing of objections;
3.1.8. for billing administration;
3.1.9. to improve the operation of the website;
3.1.10. statistics and market research;
3.1.11. for security purposes.
3.2. The controller processes the following personal data:
3.2.1. for processing registration data - first name, last name, email, password.
3.2.2. for processing delivery data - name, surname, e-mail, mobile phone, address, delivery method, payment method, payment information.
3.2.3. cookies – Customer browsing history and behavior on the Controller's website.
3.2.3. for processing accounting data – order history, payment information, delivery information.
3.2.3. for marketing information – name, surname, telephone number, e-mail address, device identification number. 3.2.3. for rights of claim – name, surname, contact information, order and delivery information.
3.3. Processing of personal data for commercial purposes is carried out only if the Customer has freely given, specific, informed and unambiguous indication that the Customer agrees to such actions. The Customer may object to receiving commercial communications in accordance with legal acts without giving his consent to receiving commercial communications (for more information on commercial communications, see Section 6 of the Terms).
3.4. Processing of personal data may be carried out in an automated manner, including by profiling the Customer in order to provide new, special, individual offers of the Controller to a specific customer, taking into account the information obtained and automatically collected by the Controller from the personal data provided by the customer and previous purchases on the Controller's website, if the customer has consented to this.
3.5. The Controller may carry out automated decision-making in relation to the Client if the Client has freely given, specific, informed and unambiguous indication that the Client consents to such actions. The Client may object to automated decision-making in accordance with legal acts by not giving his consent to the automated processing of personal data.
3.6. Automated decision-making is carried out by the Controller, for example, to prepare and place commercial notifications (pop-up banners) on the website, to advertise the goods available on the website and to help Customers make their choice in the range of goods offered, including based on the information placed in commercial notifications (pop-up banners) about the most popular goods. By agreeing to the automated processing of personal data for this purpose, the Customer agrees that the Controller will use information about the goods purchased by a person on the website by placing commercial notifications (pop-up banners) on the website, which will indicate the following data: information about the purchased goods, an image of the goods from the website and anonymized information about the person who has purchased a specific good, indicating in the “pop-up banner”, for example: “A customer from Riga has just purchased… (information about the goods in accordance with the above).
3.7. The Controller performs automated decision-making to send the Customer a reminder about the products placed in the shopping cart of the customer's profile on the website.
3.8. The Controller uses automated decision-making to ask the Customer to submit a review of a product, which is included in the statistics on the evaluation of the product without any information identifying the Customer.
3.7. Opting out of receiving commercial communications does not have any legal consequences for the Customer and does not limit the Customer's right to purchase goods and services on the website.
3.8. Opting out of automated data processing for the purposes specified in the Terms does not have any legal consequences for the Customer and does not limit the Customer's right to purchase goods and services on the website.
What personal data do we transfer to third parties?
4.1. We may transfer the Customer's personal data to the recipients of the categories of data specified below:
4.1.1. Financial transactions related to the purchase of goods on the website may be processed by the Controller's payment service providers. We disclose the Customer's financial transaction data to the Controller's payment service providers to the extent necessary for the execution of payment transactions, refunds and handling of complaints.
4.1.2. For the purpose of providing specific services, we may transfer the Customer's personal data to other service providers, such as website hosting service providers, courier services, server and technical maintenance service providers, email service providers, accounting service providers.
4.2. We may transfer the Client's personal data not only in the cases indicated above, but also in fulfilling our legal obligations, as well as, if necessary, to protect the interests of the Client or other persons, for example, when applying to court or state institutions.
4.3. We may transfer the Client's personal data to state institutions in accordance with the laws and regulations in force in the Republic of Latvia, in accordance with the procedure and to the extent specified in the laws and regulations.
4.4. For direct marketing purposes, we may transfer personal data with the Customer's consent to our partners who provide us with marketing services.
4.5. We will engage only those service providers who have implemented appropriate technical and organizational measures that will ensure an appropriate level of data processing security, which ensures the procedures specified in regulatory enactments - a level of personal data processing and protection equivalent to the requirements set out in the General Data Protection Regulation.
4.6. In certain cases, in compliance with the requirements of regulatory enactments, personal data is accessed by the Controller's cooperation partners located in third countries (i.e. countries outside the European Union and the European Economic Area): developers or service providers in the status of data processor.
4.7. In the cases referred to in paragraph 4.6., the cooperation partners engaged by the Controller in third countries ensure a level of data protection that is equivalent to the level of data protection provided by the Controller.

Commercial communications
6.1. A commercial communication is any communication in electronic form intended for the direct or indirect advertising of goods or services, or for the promotion of the image of a merchant, organization or person carrying out a commercial activity, economic activity or regulated professional activity. Information that provides direct access to general information about a service provider and its activities (domain name or electronic mail address) is not considered a commercial communication.
6.2. The Controller may use personal data to provide information about the services, promotions, and other activities offered by www.amalii.lv .
6.3. By using www.amalii.lv , you can apply (give your consent) to receive commercial communications.
6.4. The consent given by the Client to receive commercial communications is valid until its withdrawal (including after the termination of the service agreement). The Client may at any time refuse to receive further commercial communications in any of the following ways:
6.4.1. by making a relevant mark in your user profile www.amalii.lv ;
6.4.2. by sending an e-mail to info@amalii.lv;
6.4.3. in person at the point of sale;
6.4.4. using the automated option provided in the commercial communication to opt out of receiving further communications by clicking on the opt-out link at the end of the relevant commercial communication (e-mail).
6.5. SIA “LINGENT” stops sending commercial communications as soon as the Customer's request is processed. The processing of the request depends on technological capabilities, which may take up to three days.
Your rights
7.1. the right to receive information about the processing of personal data;
7.2. the right to access your personal data that we store;
7.3. the right to request correction of your personal data that we hold about you (you can correct most of it by logging into your account);
7.4. the right to ask us to delete your personal data (“right to be forgotten”);
7.5. the right to restrict the processing of your personal data;
7.6. the right to object to the processing of your personal data;
7.7. the right to object to the processing of your personal data for direct marketing purposes;
7.8. the right to object to the automatic processing of personal data;
7.9. right to data portability;
7.10. the right to withdraw consent to the processing of your personal data;
7.11. the right to submit a complaint to the supervisory authority;
7.12. If you wish to exercise your rights, or if you have any questions about the processing of personal data or the exercise of your rights, please contact us by email.
7.13. If you believe that we are violating the legal acts regulating the protection of personal data by processing your personal data, you have the right to file a complaint with the Data State Inspectorate, located at Elijas iela 17, Riga, LV-1050, https://www.dvi.gov.lv/lv/ . In all cases, contact us before submitting a complaint so that we can find a suitable solution together.
Consent and Privacy Policy Changes
8.1. By using the online store www.amalii.lv and/or participating in the activities of www.amalii.lv, the Customer confirms his/her consent to the processing of personal data.
8.2. Withdrawal of consent does not affect data processing carried out at the time when the Customer's consent was valid.
8.3. Withdrawing consent does not prevent data processing carried out on other legal grounds.
8.4. Upon receiving a request from the Client to exercise his/her rights, the Controller shall verify the identity of the Client, evaluate the request and execute it in accordance with regulatory enactments.
8.5. The Controller shall send the response to the Client by registered mail to the contact address specified by the Client, an electronically signed response by e-mail at the Client's request, taking into account, if possible, the method of receiving the response specified by the Client.
8.6. The Controller ensures compliance with data processing and protection requirements in accordance with regulatory enactments and, in the event of a Customer's objection, takes appropriate steps to resolve the objection. However, if this fails, the Customer has the right to contact a supervisory authority.
8.7. The Controller reserves the right to unilaterally change and supplement the Privacy Policy at any time without notice, publishing the changes on www.amalii.lv in the Privacy Policy section.
